Terms & Conditions

How we work together

Last updated: 1 April 2025

1. Acceptance of Terms

By engaging AQ Line Marking ("we", "us", "our") for line marking services, you accept these terms and conditions. Any variations must be agreed in writing by both parties.

2. Quotations and Pricing

All quotations are valid for 30 days from the date of issue. Prices are in Australian dollars and include GST unless stated otherwise. Quotes are based on information provided and site conditions at the time of inspection. Unforeseen conditions may result in price adjustments, which will be communicated before work proceeds.

3. Payment Terms

Payment is due within 14 days of invoice date unless otherwise agreed. For larger projects, progress payments may be required. A deposit may be requested for custom materials or specialized equipment. Overdue accounts may incur interest charges in accordance with South Australian law.

4. Scope of Work

The scope of work, including specifications, colors, line widths, and materials, will be detailed in your quotation or project brief. Any changes to the agreed scope must be requested in writing and may result in additional charges or schedule adjustments.

5. Site Access and Client Obligations

Clients must provide safe and unobstructed access to work areas at agreed times. This includes completing any required site inductions, providing parking for vehicles and equipment, and ensuring surfaces are clean and dry. We are not responsible for delays or quality issues arising from inadequate site preparation, contaminated surfaces, adverse weather, or third-party activities beyond our control.

6. Health and Safety

We operate in accordance with South Australian Work Health and Safety legislation. We reserve the right to suspend or cease work if conditions become unsafe. Clients must notify us of all site hazards, permit requirements, and specific safety procedures prior to work commencing.

7. Weather and Delays

Line marking requires suitable weather conditions. Work may be postponed due to rain, extreme temperatures, or high winds. We are not liable for delays caused by weather, site access issues, client delays, or circumstances beyond our reasonable control.

8. Warranty

We warrant that work will be completed in a professional manner using appropriate materials and techniques. Defects arising from faulty workmanship will be rectified within a reasonable timeframe. Warranty excludes damage from abnormal traffic, improper use, surface deterioration, maintenance by others, or factors outside our control.

9. Liability

Our liability is limited to the value of services provided for the specific project. We are not liable for indirect, consequential, or economic losses. Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded.

10. Intellectual Property

All designs, layouts, and documentation remain our intellectual property until payment is received in full. We may photograph completed works for marketing purposes unless you request otherwise in writing.

11. Termination

Either party may terminate the agreement with written notice if the other party fails to remedy a material breach within 10 business days. Clients remain liable for all work completed and materials procured up to the date of termination.

12. Governing Law

These terms are governed by the laws of South Australia. Any disputes will be subject to the exclusive jurisdiction of South Australian courts.
